Dear Mr. Davis:

Recently, I wrote to your office about guidelines governing persons with life sentences and life sentences either concurrent or consecutive with other sanctions. In response, I received a copy of Policy 2-8 (Hearing Date for Homicide Cases [Portion Suspended]).

The purpose of this letter is to seek further information, obtain copies and answer the following questions:

  1. What guideline(s) were amended, codified or affected by the passage in the 1992 legislative session of House Bill No. 1090 (which took effect on October 1), which amended the parole statute with regard to multiple sentences and "aggregate terms"?

  2. What guideline(s) govern the frequency of "set off" and is there a process by which a prisoner may challenge a "set off" determination?

  3. What guideline(s) govern the Parole Commission's recommendation for parole and referral of a person to the Governor's Office for approval?

  4. What guideline(s) govern life (or more serious) sentences when the offense is not homicide?

  5. Is there an index, table of contents or other listing of all Parole Commission guidelines extant?
