Re: Policies on Homosexuality
Dear Mr. Davis:
I have received an inquiry from a Mr. John W, 191-###, Central Laundry Facility expressing his view that he has been discriminated against because of his homosexuality, in particular, because of the fact that the Parole Commission requires a successful psychological test for a favorable outcome and this inmate's sexual orientation precludes a positive decision.
The inmate describes that he has 8-1/2 years in on a 12 year sentence with no infractions for 3-1/2 years. He does mention that he had been raped early on, but that is not the issue here. Clearly, his assignment to CLF shows that he has been granted a very high level of classification.
The question here is that the psychological demanded by the Parole Commission is unfairly biased as to sexual orientation, a largely irrelevant factor as to otherwise valid correctional interests.
I would like clarification of the Parole Commission's stance on this issue and assurance that the psychological tests as now administered can be made free of extraneous factors not having a bearing on correctional outcome.
